Closed Beta terms
These terms apply between you and Maxim Kirilchuk, Bulgaria, who runs the Memotongue Closed Beta (contact: privacy@memotongue.com). You accept them when you create an account. How your data is handled is described in the privacy notice.
1. Who can take part
- The beta is by invitation only. An account is for adults aged 18 or older living in the EU.
- A child takes part only through a Kids profile in a parent's account, and only when that parent has agreed to these terms. The parent is responsible for the child's use of the app.
- Young people aged 11 to 17 do not take part during the beta: an adult profile is only for an adult.
- An invitation is personal: please do not pass it on.
2. What a beta means
- The beta is free. Nothing is sold during it.
- It is a test version: it may contain errors, and features may change, be removed or work differently from the final app.
- The beta is run by one person. The service may be unavailable for days without notice. Your data is kept: the app works offline and syncs when the server is back.
- The database is backed up continuously, so a mistake or a broken database can be undone. Until the backups move to a second data centre, losing the server itself could lose data.
3. Your content
The words, examples and notes you add stay yours. You allow Memotongue to store and process them only to provide the service to you. Do not add anything unlawful or other people's personal data.
4. Feedback
Feedback is the point of the beta, and it is welcome at any time. Memotongue may use your suggestions to improve the app without owing you anything for them. Feedback is never published with your name without your permission. Feedback sent through TestFlight or Google Play reaches us with your email and any screenshot you attach: never attach a screenshot of a Kids profile.
5. Fair use
Do not attack or overload the service, try to reach other people's data, or get around its limits. Access may be suspended to stop such use.
6. From the beta to the public launch
If Memotongue launches publicly:
- Your account and all its data carry over to the public app unchanged.
- On launch day the beta's free access ends. Testers who studied on at least 10 days during the beta (a study day is a day on which at least one study session with at least one card was completed) receive Family PRO free for 6 months; after that the account becomes Free unless you subscribe.
- All other testers become Free and receive the 14-day trial.
- You are told in the app 14 days before the launch.
7. Leaving and ending the beta
You can stop at any time and delete your account (privacy notice, section 7). The beta, or your access to it, may end with at least 14 days' notice in the app, so you can export your data first; access is stopped earlier only to end misuse under section 5. If the beta ends without a public launch, all data is deleted within 30 days after the end.
8. Liability
The beta is provided free and as it is. To the extent the law allows, there is no liability for its being unavailable or for errors in it. Nothing in these terms limits liability for intent or gross negligence, for harm to life, body or health, or the rights that consumer law gives you and that cannot be waived.
9. Law
Bulgarian law applies. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring a claim in its courts.
10. Changes
These terms may change during the beta. Each change gets a new version and you are told in the app; an important change applies to you only once you agree to it.
